Arbitration

Structuring of clauses and handling of business disputes submitted to arbitration.

Arbitration allows the resolution of disputes over disposable property rights, subject to the requirements of the law. Its use depends on a valid agreement and an analysis of which parties and controversies are covered. The choice of institution, seat, language and procedural rules has practical consequences and must be compatible with the contract and the transaction. The clause should not be treated as a standardized formula independent of the other instruments governing the business relationship.

Advisory work involves negotiating the arbitration agreement and acting in the proceedings, including organizing evidence and urgent measures when applicable. Corporate and financial matters may require coordination among different contracts and interested parties. Confidentiality depends on the applicable regime and instruments and is not an absolute legal feature of every arbitration. The judiciary retains support and oversight functions within the limits set by law, including in matters of enforcement and recognition of foreign awards.

Is every arbitration automatically confidential?

No. The treatment of confidentiality depends on the agreement, the applicable rules and the governing standards. There are situations involving duties of transparency or disclosure that must be taken into account.
