Crypto Assets and Drex

Legal analysis of digital assets, tokenization and initiatives related to the Drex project.

Private virtual assets, tokenized securities and the Drex project are not equivalent categories. Each structure involves its own issuers, rights and regimes. Drex is an initiative of the Central Bank (Banco Central) whose stages and conditions should be verified through official information, without assuming public availability or unrestricted access. Participating in pilot tests or developing compatible technology does not, by itself, constitute a general authorization to provide financial services or distribute investments.

The advisory work examines the nature of the asset, the holder's rights and the roles of issuance, custody and transfer. In tokenization projects, contracts and registration rules must clarify the link between the digital representation and the underlying right. Privacy, confidentiality and security also influence the design. Classification before the Central Bank and the CVM depends on the activities and economic substance, not only on the technology used. Changes to official initiatives require reviewing assumptions before implementing any transaction.

Our work

  • Classification of tokenized assets and rights
  • Issuance, custody and transfer contracts
  • Analysis of Drex initiatives and privacy requirements

Is Drex the same as a private cryptocurrency?

No. The Central Bank's initiative has its own nature and objectives. Its developments should be followed through official sources, without confusing the project with private token offerings.
