Civil Litigation

Handling of contractual and civil liability disputes, including relationships within the payments market.

Civil disputes within the payments chain require reconstructing the course of the transaction and the role of each participant. The user, the merchant, the acquirer, the issuer and the technology provider may hold different obligations. A chargeback is a contractual mechanism of the payment arrangement and does not, by itself, resolve every discussion of civil liability. The application of consumer protection rules and contractual provisions depends on the relationship examined, the conduct involved and the evidence available.

Legal work includes assessing the dispute, responding to complaints, defending or filing claims, and analyzing negotiated solutions. Contracts, authentication records and communications are relevant to understanding the authorization, execution and challenge of transactions. Litigation strategy must take into account requests for urgency, the need for technical evidence and the repercussions on other cases. Handling recurring claims may also point to adjustments in documentation and procedures, while preserving the distinction between dispute prevention and defense in an actual proceeding.

Does a chargeback decision end any judicial discussion?

No. The arrangement's contractual procedure and the judicial discussion have their own grounds and effects. The analysis takes into account the contracts, the applicable legislation and the evidence in each relationship.
