Payment Methods

Classification of payment institutions, arrangements and services and structuring of their operations.

The payments market brings together different activities, such as the issuance of electronic money, post-paid instruments, merchant acquiring and payment initiation. Classification depends on the role actually performed and the relationship between participants, merchants and users. Payment institution and payment arrangement sponsor are distinct roles, each with its own obligations. The legal analysis must also distinguish between a payment account, a deposit account and credit services, without assuming that a single authorization covers all of these products.

Structuring involves examining the operating model, the need for authorization and the contracts that distribute rights and responsibilities along the chain. Security, complaint handling, third-party management and fraud prevention are part of this design. Changes in product or scale may require a review of the classification. Legal support follows the preparation of documentation and compliance with Central Bank requirements, taking into account the regulation applicable to the type of institution and the intended activities.

  • Contracts with users, merchants and partners

Can a payment institution carry out any banking activity?

No. The payment services regime is not equivalent to a general banking authorization. Credit and other activities must be analyzed according to the specific license and rules.
